Partial judgment

A partial judgment , according to § 301 of German Civil Procedure (ZPO) shall be adopted by the court if several in the action asserted claims only one is ready for decision, or it can be decided only through a part of a claim. It is a final judgment with regard to the decided part, in contrast to the interim judgment on the reason according to § 304 ZPO. The partial judgment can therefore be attacked with legal remedies ( appeal or revision ) and become legally binding independently.

The court is not obliged to issue a partial judgment even if the prerequisites are met: A partial judgment is not made if the court does not consider it appropriate in the light of the situation: Section 301 (2) ZPO.
