Animal pornography

Animal pornography is the pornographic representation of sexual acts between humans and animals .

Legal situation

Germany

A legal regulation can be found in § 184a StGB ( distribution of violent or animal pornographic writings ). This is a rule of law as part of the reform of the Penal Code for 1. April 2004 was transferred to a separate paragraph. In doing so, the previously mentioned in Section 184 Paragraph 3 a. F. StGB, the same content has been adopted.

According to this regulation, among other things, the distribution and making available to the public of animal pornography as well as the production, import, export and advertising for this purpose are prohibited. The threat of punishment is imprisonment of up to three years or a fine. Possession, however, is unpunished.

Animal pornography is also known as "hard pornography". This is generally considered to be socially damaging. The legislature wants to protect the general public from being confronted with such representations through the legal provision of Section 184a of the Criminal Code. For this reason, the distribution - but not the acquisition or possession - of these representations is punishable.

Austria

In Austria until the end of 2015, under Section 220a StGB, any “advertising for fornication with animals” was prohibited. Advertising was understood to mean any public approval “that is suitable to suggest such acts of fornication.” Since there was only one conviction under this paragraph in the period from 2000 to 2013, it was ultimately considered insignificant and deleted.

However, performing a sexual act on an animal is still prohibited according to Section 5 of the Animal Welfare Act. Therefore, animal pornography falls under " hard pornography " ("lewd writings, images, motion pictures or other lewd objects") according to Section 1 of the Pornography Act, and any production, distribution, import, export, transport and storage is prohibited if this is done for profit he follows.

Private ownership and consumption are exempt from punishment.
