usTLD Dispute Resolution Policy

The usTLD Dispute Resolution Policy ( usDRP ) is an alternative dispute resolution procedure that is applicable exclusively to the domain names registered under the US country-specific top-level domain .us and was introduced by the United States Department of Commerce on February 21, 2002.

Basics

According to § 4 (a) of the usDRP, there is a right to transfer or cancellation if a domain name

  • is identical or confusingly similar to a trademark or service mark of the complainant ("Your domain name is identical or confusingly similar to a trademark or service mark in which the Complainant has rights") and
  • the domain owner has no rights or legitimate interests in the domain name ("You have no rights or legitimate interests in respect of the domain name") and
  • the domain name has been registered or is being used in bad faith ("Your domain name has been registered in bad faith or is being used in bad faith").

The only difference to the Uniform Domain Name Dispute Resolution Policy (UDRP) is that it only has to be proven that the domain name was registered or used in bad faith , whereas the UDRP requires the cumulative presence of these elements.

Statistical

Since the usTLD Dispute Resolution Policy (usDRP) was introduced, 339 cases have been pending, a very small number compared to the Uniform Domain Name Dispute Resolution Policy (UDRP) with over 20,000 cases to date. The number of cases will increase continuously, as the ccTLD “.us” is one of the fastest growing top-level domains with currently around 1.7 million registrations.
