The Regulation (EC) no. 1346/2000 on insolvency proceedings or European Insolvency Regulation issues (EIR 2000) treated insolvency law with European implications. The EuInsVO 2000 has since been replaced by Regulation (EU) 2015/848 of the European Parliament and of the Council of 20 May 2015 on insolvency proceedings (EuInsVO 2015).

The EuInsVO covers those debtors who are legally active across borders or in a Member State other than the one in which they were founded (in the case of companies). At the forefront are the questions of the jurisdiction of the bankruptcy courts , the question of the applicable law and the recognition of decisions by foreign bankruptcy courts .
