The European Union has adopted Regulation (EU) No. 1143/2014 to prevent, minimize and mitigate the adverse effects of invasive alien species on biodiversity and associated ecosystems, as well as on human health and the economy.

Regulatory content

The regulation aims to meet the obligations of the European Union under Article 8 lit. h) the Biodiversity Convention is implemented and the Aichi goals are achieved by 2020.

The regulation is based on a draft of the European Commission of 9 September 2013. Following amendments proposed by the Environment Committee of the European Parliament, the regulation was adopted by the European Parliament and the European Council on October 22, 2014 . It came into force on January 1, 2015.

The central regulatory instrument of the regulation is the list of invasive alien species of Union-wide importance . For those invasive alien species on the list, extensive restrictions apply according to Article 7 of the regulation. Invasive alien species of Union-wide importance may not be introduced, kept or bred into the territory of the EU, nor may they be placed on the market or released into the environment. According to Article 8, exemptions can be granted by the competent authorities of the member states. For non-commercial owners and commercial holdings, transitional provisions apply anyway. According to Article 13 of the regulation, the member states are obliged to carry out a comprehensive investigation of the paths of unintentional introduction and spread of invasive alien species of Union-wide importance in their sovereign territory and marine waters within 18 months of the publication of the list and to identify those paths that are due to species volume or the potential damage caused by species entering the Union through these pathways require priority action. The result of the path analysis is documented in BfN script 490. Within three years of the list being published, the member states must draw up and implement an action plan with concrete measures based on the paths identified.

National implementation

In Germany, the implementation mainly took place in Sections 40 to 40f as well as Sections 48a and 51a of the Federal Nature Conservation Act on September 16, 2017.
