The Wiesbaden Insurance Office is the administrative office of the insurance association for economic auditing and trust management . The insurance community is a co-insurance group of German insurance companies to hedge the liability risks from the professional activity of auditors , tax consultants , sworn accountants and tax agents .
The participants in the insurance community are Allianz (42.0%), AXA (34.0%) and ERGO (24.0%).
The insurance office was established in 1938 as a reaction to the establishment of the auditing profession by emergency ordinance in 1932 . Offered professional liability insurance for accountants, certified public accountants and tax consultants and their professional societies. Professional liability insurance offers protection against claims for damages resulting from the legal liability of the professional for financial loss. Protection is provided against the financial consequences of professional oversight.
The Federal Cartel Office has initiated cartel proceedings against the insurance community, in the course of which the Federal Cartel Office issued a prohibition order on August 10, 2007. From 2009, the insurance community should only be allowed to offer insurance services to the Big Four auditing companies Deloitte Touche Tohmatsu , Ernst & Young , KPMG and PricewaterhouseCoopers International . By resolution of the Düsseldorf Higher Regional Court of September 17, 2008, the prohibition order issued by the Federal Cartel Office was lifted. The Düsseldorf Higher Regional Court found that the prohibition order is unlawful and that the activities of the insurance community are exempted from the prohibition of cartels by the block exemption regulation for the insurance industry. Appeal against the decision was not admitted. The Federal Cartel Office has lodged a non-approval complaint with the BGH. This was rejected by decision of the BGH on June 23, 2009.
The insurance community continues to offer professional liability insurance for auditors, sworn accountants, tax consultants and their professional associations in Germany and Europe.
