Partial jurisdiction

from Wikipedia, the free encyclopedia

The Vogteiliche jurisdiction or also Vogteigerigh-level jurisdiction was a legal institution of the Middle Ages and the early modern period, which formed the core competence of the Bailiwick .

definition

The Vogteiliche jurisdiction arose during the 16th century from the merging of the civil jurisdiction, which up until then the medieval regional courts were entitled to, with the lower jurisdiction based on the manorial ownership . As a result of this development, the area of competence of the high judiciary was narrowed to the practice of the four or five "high reprimands" (murder and manslaughter, serious and bloody bodily harm, theft, rape and nightly arson). The entire remaining jurisdiction, however, now fell within the jurisdiction of the bailiff's jurisdiction, which thus included both the lower and the middle jurisdiction .
