Execution target

from Wikipedia, the free encyclopedia

The execution goal defines the purpose of the execution of a prison sentence . It is therefore the purpose of punishment to distinguish where it comes to the meaning of the imposition of penalties.

In Germany, the enforcement objective is set out in Section 2 sentence 1 of the Prison Act (StVollzG):

"In the execution of the prison sentence, the prisoner should be able to lead a life without criminal offenses in the future in social responsibility (prison goal)" .

The enforcement goal is thus the yardstick and orientation for all efforts in the penal system . This means that the inmate during the penal system (d. H. In freedom) back to life "outside" is to be prepared and that he should learn not to become criminals again. The aim of rehabilitation is to enable the prisoner to lead a peaceful and industrious life within society.

In the NJvollzG (Lower Saxony Justizvollzugsgesetz), Section 5 explains the enforcement goals: Sentence 1 "In the execution of the prison sentence, the prisoners should be able to lead a life without criminal offenses in future in social responsibility." Sentence 2 "At the same time, the implementation of the prison sentence serves to protect the General public from further criminal offenses. "

According to Section 4, Paragraph 1, Sentence 1 of the StVollzG, the prisoner participates in shaping his or her treatment and in achieving the goal of the execution . Section 4 (1) sentence 2 StVollzG orders that the prisoner's willingness to do this is to be awakened and encouraged .
