The central pension register records power of attorney and care directives , also in connection with living wills . The purpose of registration is to avoid the process of appointing a supervisor by the supervisory court and, if necessary, to make it easier for the court to find an authorized representative. It has been operated by the Federal Chamber of Notaries since 2003 . By the end of 2019, certificates from more than 4.6 million citizens had been registered. The register is queried over 20,000 times a month.

Emergence

The central pension register was set up by the Federal Chamber of Notaries . Originally it only recorded power of attorney that was notarized . Since March 1, 2005, as a result of a change in the law (amendment to the Federal Notary Code (§ § 78a ff. BNotO)) and the creation of the Provision Register Ordinance , privately written power of attorney can also be registered online. Since September 1, 2009, care orders can also be recorded.

The central pension register records the necessary information about the respective pension certificate in order to avoid unnecessary and undesired legal supervision. Pension certificates are

The name of the principal or the person making the declaration, the scope of the authorization and the data of the respective person of trust are saved as relevant data.

The pension certificate itself is not deposited with the Federal Chamber of Notaries. In the same way, registration does not replace the granting of the power of attorney itself. In order to clarify difficult legal questions when drafting a pension certificate, it is advisable to consult a notary or a lawyer . Often the pension deed also needs the notarial form to be effective .

When registering, the pensioner is given a credit card-sized card ("ZVR-Card"), which is used to refer to the pension certificate and the person or persons of trust.

If necessary, the competent court will consult the central pension register. Private service providers who offer such registrations for a fee, however, are not contacted by the competent court.

Information of the authorized representative

The selected person of trust will be notified in writing after registration and informed of the stored data relating to them. This serves to protect the right to informational self-determination. An indication is given that there is a right to have the data deleted.

Legal Effects of Registration

The entry of the pension certificate in the register does not replace the granting of the power of attorney itself. The existence and scope of the power of attorney are absolutely independent of the registration. In the same way, no content check is carried out during registration and no legal offense is created with the registration .
