Orphan allowance

In the law on civil servant pay , orphan's allowance refers to the pension that a child of a deceased civil servant can receive.

Legal bases

The orphan's allowance is regulated for federal civil servants in Section 23 BeamtVG. According to Section 61 (2) BeamtVG, orphan's allowance is generally paid up to the age of 18. It is granted on application for the duration of vocational training up to the age of 27; if the orphan is unable to support himself due to a handicap, he will receive orphan's allowance without any age limit.

Income offsetting against the orphan's allowance has not taken place since January 1, 2016. Only in the case of handicapped children is income still credited to the orphan's benefit, provided that it exceeds twice the minimum full orphan's benefit (orphan's benefit taking into account the minimum pension).

Amount of orphan's allowance

According to § 24 BeamtVG, the orphan's benefit amounts to 12 percent for half orphans and 20 percent of the pension that the civil servant would have received if he had retired on the day of his death. If the civil servant dies as a result of an accident at work , the orphan's allowance amounts to 30 percent of the pension (regardless of whether the child is half or full of parents). Full orphans receive the family allowance in addition to the orphan's allowance . If the full orphan does not already receive child benefit , an amount corresponding to the amount of the child benefit will be paid.
