Housing assistance

The housing assistance is a benefit for the reintegration into working according to § 102 of the Ninth Social Code and § 22 of the heavy disabled persons levy Regulation (SchwbAV). This entitlement to benefits is not defined in any other place.

Scope of services

According to SchwbAV, the cost bearer of the rehabilitation can grant severely disabled people according to § 22 SchwbAV benefits in the form of assistance in the procurement, furnishing and maintenance of a disability-friendly apartment, such as

  • Procurement of disability-friendly living space within the meaning of Section 16 of the Housing Promotion Act,
  • Adaptation of living space and its equipment to the special needs and disabilities
  • Relocation to a disability-friendly apartment or an apartment that is considerably more convenient to the workplace.

These services can be provided as grants, interest subsidies or loans. The amount, repayment and interest are determined by the circumstances of the individual case.

The prerequisite for performance is the goal of reintegration into working life. In the case of assistance with the procurement of living space, the funding requirements according to the Housing Funding Act (WFG) must be met. Measures that are part of personal lifestyle, improve the quality of life or meet elementary basic needs (such as bathroom, kitchen, bedroom) are not eligible.

Responsibilities

The integration office of the local government can only provide housing assistance for the self-employed and for civil servants for whom no other rehabilitation provider is responsible. For all other severely disabled people, the rehabilitation payer is responsible according to the fifth book of the social code (health insurance), the sixth book of the social code (pension insurance) or the seventh book of the social code (statutory accident insurance) or unemployment insurance ( third book of the social code ).

Deadlines

The application must be submitted to the sponsor before the procurement or furnishing of the living space and approval must be awaited. After the application has been submitted, an application for an early start of the construction project can be submitted. If the insurance provider fails to start early, a lawyer should be called in.

Required documents

The insurance provider needs the following documents:

  • fully completed application form,
  • Copy of the severely handicapped ID card or
  • Copy of the equality notice
  • Copy of the assessment notice from the pension office
  • Copy of the estimate and
  • Copy of the planning documents, which contain the proof of the disability-friendly equipment,
  • Copy of the proof of income of all employees in the family for the income expected in the next 12 months,
  • Copy of the living space calculation,
  • Copy of the financing plan and
  • Copy of proof of financing.

In accordance with the Administrative Procedure Act (VwVfgG), the processing authority is not entitled to original documents; the processor must, if necessary, authenticate himself after inspecting the original documents at the authority's expense.
