Push back

In German law on foreigners, a measure that terminates residence is referred to as postponement . In contrast to being rejected at the border, a removal presupposes that the foreigner has entered the federal territory without permission. According to Section 57 of the Residence Act, the removal should be carried out within six months. However, it is possible for the authorities to refrain from doing so in special circumstances, for example for humanitarian reasons.

The foreigner can be taken into detention pending removal; the provisions of detention pending deportation ( Section 62 AufenthG) apply accordingly. An objection has no suspensive effect in accordance with Section 80 (2) sentence 1 no. 2 VwGO . In accordance with Section 11 of the Residence Act, deportation triggers  an entry and residence ban - like expulsion and deportation . At the request of the person concerned, this entry and residence ban can be limited.
