The public recommendations for vaccinations and other protective uses are made by the highest state health authorities (according to Section 20 (3 ) IfSG ) . The federal states are responsible for the federal implementation on the basis of the respective recommendations of the Standing Vaccination Commission (STIKO) .

This can be as a direct takeover of listed in the STIKO recommendations and recommended vaccinations done. It is also possible that the state will publish its own list of public recommendations for vaccinations. This can deviate from the STIKO recommendations and, for example, contain additional vaccinations. The group of people for whom a vaccination recommendation is made may also differ from the indication groups published by the STIKO. For the Free State of Saxony, the vaccination recommendations are made by the Saxon Vaccination Commission.

Legal meaning

The main importance of the public recommendation of protective vaccinations by the individual federal states lies in the legal protection of the vaccinating doctor and the care of the vaccinated person in the event of damage to health as a result of a vaccination ( vaccination damage ), as specified by §§ 60 ff. Of the IfSG is regulated.

The existence of a public vaccination recommendation for the federal state in which a vaccination was carried out is one of the prerequisites for recognition of vaccination damage. Other requirements include:

  • The vaccination must be carried out correctly and in accordance with the currently valid recommendations of the STIKO.
  • An approved vaccine must have been used; A federal state can make regulations for special cases so that a public vaccination recommendation is issued for vaccines not approved in Germany.
  • In the case of combination vaccines, there must be a public recommendation for all individual components.

The procedure for recognizing a vaccine damage is carried out after reporting to the respective pension office .

Reporting requirement

A vaccination reaction that goes beyond the usual extent is notifiable under the Infection Protection Act (IFSG) if the symptoms that occur after a vaccination could be causally related to the vaccination . The report is usually made by the treating or vaccinating doctor to the responsible health department and / or the Paul Ehrlich Institute . The treating or vaccinating doctor is obliged to report. In addition to this reporting obligation, there is also a reporting obligation under the Law on the Trade in Medicinal Products ( Arzneimittelgesetz - AMG).
