The ordinance on the prerequisites and the procedure for the accreditation of competent bodies and for the approval of institutions and measures of employment promotion according to the Third Book of the Social Security Code (Accreditation and Approval Ordinance on Employment Promotion - AZAV) is a statutory ordinance of the Federal Ministry of Labor and Social Affairs (BMAS) based on § 184 SGB ​​III . It came into force on April 6, 2012. At the same time, the Recognition and Admission Ordinance - Further Education (AZWV) of June 16, 2004 expired ( § 8 sentence 2 AZAV).

The AZWV was an ordinance of the then Federal Minister for Economics and Labor in agreement with the Federal Ministry for Education and Research. The legal basis was the then § 87 SGB ​​III , which was inserted into SGB ​​III with the Second Law for Modern Services on the Labor Market ( Hartz II ) on January 1, 2003.

The AZWV has been regulating the procedure for external certification of educational institutions and further training measures since July 1, 2004 , as well as the required accreditation of the certification agencies and quality assurance in relation to the certification bodies in order to design further professional development services in a more targeted manner.

The education vouchers issued by the employment agencies or the working groups for basic security to jobseekers could only be redeemed for educational measures certified according to AZWV at appropriately certified educational institutions.

According to the AZWV, educational institutions and their educational measures could be certified by so-called specialist bodies (VCS). This meant that with a carrier and measure certification by a competent body, an educational institution (association, GmbH, gGmbH, etc.) as an approved educational institution in connection with §§ 7,8 AZWV and with the respective (certified) further training measure as an approved further training measure according to § 85 SGB III. The approval was granted by an independent expert body ( certification bodies ).

Extract from the AZWV (§ 8 Paragraph 4):

A system for quality assurance in accordance with Section 84 No. 4 of the Third Book of the Social Security Code exists if a systematic instrument for quality assurance and quality development that corresponds to the recognized rules of technology is documented, effectively applied and its effectiveness is constantly improved. In particular, the application must contain documentation
  1. a customer-oriented model,
  2. the consideration of labor market developments in the design and implementation of training measures,
  3. the way in which company goals are set as well as teaching and learning goals, methods including the methods of assessing the success of integration,
  4. the methods for promoting individual learning processes,
  5. a regular evaluation of the offered measures using recognized methods,
  6. company organization and management,
  7. conducting our own reviews of the functioning of the company,
  8. the willingness to work with external specialists for quality development and
  9. the target agreements, the measurement of the degree of target achievement and the control of ongoing optimization processes on the basis of key figures or indicators.

The VCS was recognized in accordance with AZWV and DIN EN ISO 17021 and was recognized by the Federal Employment Agency's recognition body. The procedure according to the AZWV was made more concrete through recommendations of the Recognition Advisory Board formed at the recognition body. The Recognition Advisory Board advised and supported the recognition body and provided binding interpretations.

Accreditation and Admission Ordinance Employment Promotion (AZAV) of April 2, 2012

With the law to improve integration opportunities on the labor market of December 20, 2011, a new chapter on the approval of institutions and measures was added to SGB III. The AZWV has been replaced by a new ordinance of the BMAS, which essentially contains regulations on the licensing of vehicles and the licensing procedure.

The education vouchers or activation and placement vouchers (AVGS) issued by the employment agencies or the working groups for basic security to jobseekers can only be redeemed for training measures certified according to AZAV with appropriately certified training providers or with appropriately certified recruitment companies.

The AZAV divides the training providers or recruitment companies into different specialist areas:

  2. Private recruitment agencies
  3. Career choice and professional training
  4. continuing Professional Education
  5. Transfer payments
  6. Rehabilitation-specific measures

The approval of carriers takes place via a document review and a subsequent on-site audit, while the approval of measures is usually a document review. The requirements described in the AZAV are specified by the recommendations of the advisory board in accordance with Section 182 SGB III and implementation instructions in accordance with Section 6 (2) AZAV of the Federal Employment Agency and are binding.
