In Germany, a competent body is an institution within the framework of social legislation that has certain experts at its disposal to give a written opinion on a matter.
Business start-up
Anyone for a start-up from the unemployment a start-up grant requested from the employment agency or the German Pension Fund, according to need § 93 para. 2 sentence 2 SGB III, the sustainability of start-up by the opinion of a so-called competent body to prove. This can be freely chosen by the founder. An expert opinion can also be requested from the approving capital provider (e.g. business development agency , credit institute) in the case of financing questions (e.g. loans, grants) .

tasks
The statement serves to examine the feasibility and viability of the start-up project at the beginning and end of the funding period. The personal and professional requirements that the founder makes the basis of his decision are checked, as well as the figures in the business plan (capital requirement, cost structure and profitability). The opinion of the competent body is the establishment of the plausibility of the founding concept. In no way is this a guarantee of effectiveness. The elements include:
- Information about the founder
- Information on the planned date of foundation
- Information on the business idea (in a few sentences)
- Information on the place of self-employment (e.g. own workshop, travel trade , etc.)
- Details of the expert
- Information on the documents submitted (usually curriculum vitae , capital requirement and financing plan , sales and profitability forecast)
- Opinion on the load-bearing capacity on the basis of the documents submitted and the regular accompanying discussion
- Declaration for forwarding the statement to the requesting institution (e.g. in the case of bridging allowance or business start-up grant to the employment agency )
Opinions
When choosing the specialist position, it must be taken into account that some positions charge a fee for processing, which is often between € 30 and € 150. Statements from the IHK and HWK are usually free of charge . However, their consultants are not entrepreneurs themselves and can hardly bring their own experience as entrepreneurs to the table. Nevertheless, funding providers set certain quality criteria. The expert opinion should not only relate abstractly to a written business plan. But also take into account interview impressions, founding motivation and founding personality.
history
Expert opinions were required for the first time with the introduction of the bridging allowance. Until the introduction of the start-up grant on August 1, 2006, this also applied to the funding of the so-called Ich-AG . In a business instruction issued at the time, the Federal Employment Agency made it clear that it could not function as a competent body due to a lack of capacity. Qualified positions for business start-ups according to § 93 SGB III are not to be confused with qualified positions according to § 177 SGB III, which certify education providers for the education voucher and other measure providers according to the Recognition and Admission Ordinance (AZWV) .
