Labor jurisdiction (France)

The labor courts in France has many special features. Disputes of the labor law are in France before the civil courts negotiated, however, there is an independent court of first instance, the Conseil de Prud'hommes .

The court system in France for labor disputes has three levels: the first instance is the Conseil de Prud'hommes , the second instance the Cour d'Appel and the third and final instance the Cour de Cassation .

  • The Conseil de Prud'hommes is bilateral, ie it consists of an equal number of representatives from employers and employees. From this it follows that no professional judges decide in the council.
  • Cour d'Appel and Cour de Cassation are courts of ordinary jurisdiction and not separate labor courts. The Cour d'Appel can be appointed; the possibility of revision to the Cour de Cassation .
