Census working group

The Census Working Group ( AK Zensus for short ) was created as a nationwide association to coordinate a joint approach to the 2011 Census and the 2011 Census Act on which it is based .

After the unsuccessful submission of a constitutional complaint against the 2011 Census Act, the working group tries to clear up and provide information about the 2011 census.

There are no conventional structures within the working group, it is not a registered association and it has no formal membership. Rather, those who register on one of the working group's mailing lists and actively participate in political work and internal discussions are involved.

Decisions of the working group are partly made after unclear and controversial decision-making mechanisms via the mailing lists.

The working group is financed by those involved, but also through donations and, indirectly, by the ideal and structural support of the participating organizations, such as the working group for data storage , digitalcourage (formerly FoeBuD), the FIfF and the Chaos Computer Club .

founding

The Zensus working group was founded at the SIGINT conference in Cologne , organized by the Chaos Computer Club from May 22 to 24, 2010 . After a lecture on the 2011 Census Act, around a dozen activists came together and founded the working group with the intention of organizing a constitutional complaint against this law.

For this purpose, the open mailing list as the basis for joint communication and the internet portal www.zensus11.de were installed in the course of the following weeks.

Criticism of the 2011 census

  • Lack of information and education
  • Concern for the security of the central database created in the course of the census - not anonymized in terms of time.
  • The principle of data economy is not taken into account : In Germany, information is collected that is not required by the underlying EC directive, such as questions about one's own and parental migration background going back to 1955, the question of religious affiliation and the (only voluntary) question about belief and to the creed.
  • Non-traceability of the security of the IT systems used.
  • Misappropriation of data at registration offices and the Federal Employment Agency.
  • Lack of immediate anonymization of the data collected.
  • Doubts about the implementation of the foreclosure requirement (derived from the census judgment ).
  • Criticism of the lack of anonymization of the surveys in so-called “sensitive special areas”.
  • Surveys or surveys of data from all people living in “special areas”.
  • Adherence to the obligation to provide information enforced with a fine or penalty payment .
  • Execution of the federal states implementing laws: for example, regarding the selection of the surveyors (“census takers”).

Filing the constitutional complaint against the census law

The constitutional complaint, which was drawn up together with a lawyer from Bremen and supported by 13,077 supporters, was submitted to the Federal Constitutional Court in Karlsruhe on the last possible day, July 16, 2010.

By decision of the Federal Constitutional Court on September 21, 2010, which was published on October 1, 2010, the complaint was not accepted for decision because the reasons for acceptance according to Section 93a (2) BVerfGG would not be present.

Continuation of work

The Census Working Group has nevertheless continued its work and has since carried out educational work by providing information materials, organizing lectures and discussions, and encouraging actions and requests for information from the authorities.

Work against 2021 census

In cooperation with the Society for Freedom Rights , the AK Zensus is continuing the fight against the law passed in the Bundestag in October 2018 to prepare for the 2021 census. This law plans the test transmission for the central storage of extremely sensitive data of all German citizens from the statistical state offices from January 13, 2019. This includes name, gender identity, marital status and religious affiliation. Attorney Benjamin Derin filed an urgent application against the unnecessary and dangerous transmission of registration data to the Federal Constitutional Court on January 10, 2019.
