Exhibition priority

Introduced in 1904 in Germany by the Act Exhibition Exhibition priority prevented during the registration of industrial property rights patent and utility model , the attribution of the exhibition of the invention to subject to certain formalities prior art . While the exhibition priority in German patent law in implementation of the Strasbourg Patent Convention of November 27, 1963 ( Federal Law Gazette 1976 II p. 649, 658 ) has been severely restricted since 1978 and practically only covers exhibitions of the rank of a world exhibition ( Section 3 (5) No. 2 DE-PatG , in parallel for European patents Art. 55 (1) lit. b EPC ), the issue priority in German utility model law has remained essentially unchanged and was integrated into utility model law in 2004 through the design reform law as Section 6a DE-GebrMG .

The exhibitions recorded have been published in the Federal Gazette (previously in the Federal Law Gazette ) since January 1, 2014 , based on notices made by the Federal Ministry of Justice and Consumer Protection .

The Austrian patent law recognizes an exhibition priority corresponding to the German one ( § 3 Abs. 4 S. 3 AT-PatG ). The Austrian utility model law has no corresponding regulation, but the relevant cases are covered by the grace period in Section 3 (4) AT-GmG .

The Swiss patent law regulates the issue priority in Art. 7 lit. b CH-PatG .
