Construction Labor Law

The Bauarbeitsrecht includes for the relationship between employers and employees in the construction industry applicable special labor law provisions. These result partly from the law and partly from collective bargaining agreements. There is also extensive case law in the field of construction labor law .

The technical term was developed by Klaus Englert and Josef Langenecker. This subject was taught for the first time in 2003 at the Deggendorf University of Applied Sciences in the Faculty of Civil Engineers.

Of particular importance are the sectoral ban on temporary employment , the construction minimum wage , bad weather and short-time working regulations , the construction collective agreements and the social security funds of the construction industry regulated therein, as well as the special care obligations of employers under the Occupational Safety and Health Act, especially in the case of dangerous construction work or construction work to be carried out under unfavorable weather conditions or the construction site ordinance .

The construction labor law, which is primarily designed by the collective bargaining partners, tries to do justice to the specifics of the industry, such as the dependence on weather conditions, the lack of stationary production facilities and the high fluctuation . The issues that are regulated in construction labor law often relate to social law (seasonal health resort workers, winter employment surcharge), to occupational safety law and health protection, as well as to administrative offense and secondary criminal law.
