Bavarian list of monuments

The Bavarian Monument List is the central information and administrative tool of the Free State of Bavaria for monument protection and preservation. It is a memorial register of architectural monuments, ground monuments and movable monuments. The list of monuments is kept and updated ex officio by the Bavarian State Office for Monument Preservation and can be viewed there.

Legal basis

In Article 1 of the Bavarian Monument Protection Act (DSchG), monuments are defined as "man-made things or parts thereof from a bygone era, the preservation of which is in the general interest of the general public due to their historical, artistic, urban, scientific or ethnological significance". The monuments are then divided into architectural monuments and ground monuments. Architectural monuments are “structures or parts of them from a bygone era, ... including certain historical furnishings. ... A majority of structures (ensemble) can also belong to the monuments, even if each individual structure does not meet the requirements ... "Ground monuments are" movable and immovable monuments that are or were in the ground and usually come from prehistoric times ”. The latter are also referred to as archaeological monuments in literature.

The law stipulates in Article 2 that the architectural monuments and the ground monuments are to be included in a register known as the “List of Monuments”. This list is to be kept by the Bavarian State Office for Monument Preservation and can be viewed by anyone. The inclusion of an object in the list of monuments takes place in consultation with the municipality concerned. If the municipality raises objections, a decision by the Bavarian State Parliament of 1978 is submitted to the State Monument Council for a vote. A participation of the owners before or during the registration is not planned in Bavaria, they are only to be informed according to the mentioned resolution of the state parliament. This state parliament decision is questioned by lawyers.

The list has a purely informational character, i.e. it informs which objects, in the opinion of the State Office, meet the legal requirements for monuments, whereby the monument quality of an object does not depend on its entry in the list. Objects that are not included in the Bavarian Monument List can also be monuments. The entries in the list are therefore not an administrative act, they are not legally binding, but are of considerable importance in the administrative procedures (permit, development plan) as an orientation and subsumption aid.

Publications

In the years 1985-1991 the Bavarian Monument List was published in book form. At that time, a first series of eight volumes was published under the title Monuments in Bavaria (seven for the administrative districts, one for the state capital Munich). In a second series, of which only one volume was published by 2010, all listed ensembles are to be presented according to administrative district. A third series is currently in progress, in which each monument is presented with a brief description and a picture in a total of 96 volumes for the 71 rural districts and 25 independent cities.

For a while, the Bavarian List of Monuments was available on the website of the State Office for Monument Preservation. After a break, the monuments have been shown for some time via the Bavarian Monument Atlas. Its aim is to map monuments and ensembles down to the level of a building or a part of a building and ground monuments in their known extent. In addition, photos with the exterior view should be available for each monument. At the same time, the lists can be called up again.
