Accompanied handling

Accompanied contact is a term from German family law. A neutral third person accompanies the interaction between the parents or one parent with the child or children, who monitors interaction and ensures that it is in the best interests of the child. The escort is to be distinguished from the guardianship .

Legal basis

Parents and their children also have a right and duty to contact ( access rights ) when they live separately from one another (e.g. due to separate households and partnerships, separation, divorce or out-of-home care ).

The judicial order of the escorted contact is regulated in § 1684 para. 4 sentences 3 and 4 BGB : “The family court can in particular order that the contact may only take place if a third party willing to cooperate is present. Third parties can also be a youth welfare organization or an association; this then determines which individual is responsible for the task. "

In cases in which the parent caring for the child refuses to allow the person authorized to deal with the child alone, alienation can occur. Here it is advisable for the affected parent to seek help in the form of specially trained specialists in consultation with the youth welfare office (in accordance with Section 18 (3) SGB VIII).

procedure

The contact itself can take place in the apartment of the person entitled to contact, in the premises of a supporting organization or on a playground or other places. The aim is to treat the child as normally as possible. The supervisor can help and monitor, but should hold back as much as possible, because the focus is on the person authorized to deal with the child.

The youth welfare offices take care of themselves. It is also of institutions such as the German child protection agency or other recognized sources of child and youth services offered.

As part of a research project by the Federal Ministry of Family Affairs, a specialist commission developed “German standards for accompanied handling” and adopted them as recommendations for practice in the summer of 2007.
