The Operating Costs Ordinance (BetrKV) has been in force in Germany since January 1, 2004. It is based on the provisions of Section 27 of the Second Calculation Ordinance, which came into force on November 1, 1957, and its Appendix 3 and replaces this as a separate definition of operating costs . There are no changes to older rental contracts .

Changes are:

  • That garbage disposal costs also include the operating costs of garbage chutes.
  • The costs for community antenna and cable television now also include the costs that arise under copyright law for cable broadcasts.
  • In the case of water and heating costs, calibration costs are now apportionable.
  • The costs for the operation of the laundry facilities used by a tenant community such as washing machines, drying or ironing systems can now be passed on to the tenants.
