According to the Federal Constitution of Brazil, Brazilian citizenship is obtained both according to the place of birth (ius soli) and the principle of descent (ius sanguinis). To this end, the constitution differentiates between “native” and “naturalized” Brazilians.

1. Brazilian Constitution of 1988, Art. 12:

They are Brazilians :

  • a) those born in Brazil ( ius soli ), unless the parents are in a foreign civil service (e.g. diplomats);
  • b) those born abroad, if their parents are in the Brazilian service ( ius sanguinis );
  • c) the foreign-born children of a Brazilian parent (father or mother), provided they are resident in the Federative Republic of Brazil and apply at any time for confirmation of Brazilian nationality by birth. (Point c) after the 2nd constitutional amendment of June 7, 1994)

Persons who had registered their birth in a diplomatic mission abroad before the constitutional amendment in 2007 already meet the requirements of Article 12 c) without taking up residence in Brazil.

The existence of Brazilian citizenship by birth must be confirmed by a federal judge. Foreign documents must be translated into Portuguese and certified by the responsible consular post. It is advisable to register the birth at the responsible Brazilian professional consulate. Foreign birth certificates can be transferred with every first cartório in a federal state (Transcrição da Certidão de Nascimento).

The constitution also provides several options for naturalization . Foreign nationals who come from a country with Portuguese as the official language can acquire Brazilian citizenship after a continuous stay of one year, the others have to wait four years. A command of the Portuguese language , spoken and written, as well as a good repute are required .

First-degree relatives of Brazilian citizens who are wanted internationally cannot be extradited abroad.

A surrender or loss of Brazilian citizenship is not possible; naturalization therefore takes place with the acceptance of multiple citizenship .
