In the United States , 40 of the 50 states have courts of appeal. The states of Delaware, Maine, Montana, Nevada, New Hampshire, Rhode Island, South Dakota, Vermont, West Virginia, and Wyoming do not have appeals courts. The United States Court of Appeals are the highest federal appeals courts and are spread across eleven judicial districts.
