The " Council Regulation (EC) No. 834/2007 of June 28, 2007 on organic production and the labeling of organic products" ( European Organic Regulation or EC Organic Regulation ) regulates all production and marketing stages, the conditions under which agricultural products including aquaculture as food , feed or seed under the name as an ecological or biological product in the EU marketed or advertised may be. It is the successor to Regulation (EEC) No. 2092/91, which it repealed on January 1, 2009. It will be repealed with effect from January 1, 2021 by Art. 56 of Regulation (EU) 2018/848 on organic production and the labeling of organic products, which - partly with the same content - will take its place.
The ordinance ties in with the basic guidelines of the International Association of Organic Farming Movements IFOAM, in which around 750 associations from over 108 nations are organized.
Labelling
Only products that at least meet the EU organic regulation,
- may use the terms organic , ecological , biological , ecological , controlled ecological , certified organic , organic farming , organic farming , biodynamic and biological-organic use.
- may or must use the details of the checking organic inspection body (inspection body code, e.g. DE-ÖKO-070 ).
- may bear the European organic label and, if applicable, the national organic label and the name and logo of the organic farming association of which they are a member.
Until July 2006, some foods whose trademarks were registered with the word component “bio” before the organic regulation came into force were still allowed to use the corresponding name component, even if they were not produced organically, for example “Bioghurt”, “Biofit” and “ Bioreform ".
According to a ruling by the Federal Court of Justice on September 13, 2012, the use of the designation "BIO mineral water" is generally legally permissible, but the use of an organic mineral water mark in the sense of an organic seal is not.
Content
The following labeling rules apply to foods made up of several ingredients:
- If the product consists of at least 95% organic production, the designation organic or ecological may be used.
- If less than 95%, but at least 70% of the ingredients are organically grown, they may be marked as such in the list of ingredients - usually with an asterisk and a footnote.
The regulation also regulates the import of organic products from third countries .
In 1999 the EC organic regulation was supplemented by regulation (EC) No. 1804/1999, which regulates the rearing, labeling and control of the most important animal species. Genetically modified organisms and products made from them may not be used in organic farming or in the processing of organic food. This regulation is also obsolete due to the implementation regulation mentioned below.
The International Association of Organic Farming Movements (IFOAM) as a global umbrella organization in which around 750 cultivation associations from over a hundred nations are organized, has developed basic guidelines for organic cultivation, on which the legislation of the European Union and the national regulations of many other countries worldwide are based .
Details of the cultivation, production of animal food and the marketing are regulated by the Implementing Regulation (EC) No. 889/2008 of September 5, 2008 and the Implementing Regulation (EC) No. 1235/2008 of December 8, 2008 (regulation of imports from third countries) .
Since July 2010, all packaged products have been marked with a new seal according to the regulation, which was selected as the result of a competition. Products according to this standard are often abbreviated as kbA (controlled organic cultivation) .
implementation
In Germany, the implementation and monitoring of compliance with the directly applicable provisions of the EU regulation, in particular the Organic Farming Act (ÖLG) of 2008, regulates the approval of control bodies, monitoring, for example, via the Federal Agency for Agriculture and Food and the customs authorities and it contains provisions on penalties and fines, primarily to protect consumers from being misled by the misuse of organic labels.
American counterpart
The US certification of organic food NOP ( National Organic Program ) can be seen as equivalent to the EU organic seal . It is awarded by the US Department of Agriculture.
