Local model

The local model serves to primarily cover the housing needs of the local population. Such models were originally developed for communities with high influx of people . Today, however, they are also practiced in large cities . By means of a building land price regulation, municipalities want to ensure that local residents have a head start on the purchase of building land compared to financially strong newcomers .

For this purpose, municipalities acquire the residential areas intended for development before a building land designation and sell them to the privileged citizens at discounted prices. However, the municipalities can also agree with the owner within the framework of an urban development contract that he will sell some of the land to local residents. The legal basis in Germany can be found in the Building Code (cf. § 11 Paragraph 1 Clause 2 No. 2 BauGB).

However, the handling must not lead to outsiders being completely excluded from a purchase opportunity . The European Commission sees this as a violation of the ban on discrimination and therefore initiated infringement proceedings against Germany in 2006/2007. In February 2017, the European Commission, the Federal Ministry for the Environment, Nature Conservation, Building and Nuclear Safety and the Bavarian State Government agreed on adapted criteria: Applicants whose assets and income do not exceed certain upper limits are eligible for the model; in the subsequent distribution of points, up to 50 percent weighting can be assigned to the criterion of “location-relatedness”.

In practice, “catalogs of criteria” have already been developed that weight the aspects “residency” and “social need” more or less equally, often supplemented by voluntary commitment and other socially desirable criteria.
