In social law , earnings replacement income is all types of benefits from governmental and non-governmental institutions that are paid as a replacement for earnings from work. Pure compensation benefits or benefits that are paid solely on the basis of need (e.g. social assistance , unemployment benefit II ) are therefore not included in earnings replacement income.
Income replacement income that is offset against a pension due to death (e.g. widow's pension ) is defined in Section 18a SGB ​​IV .

Short-term replacement income

  • the retirement pension and comparable remuneration from a public service or office relationship or from an insurance-free employment relationship with the right to pension according to civil service regulations or principles as well as comparable payments from the pension of members of parliament,
  • the accident pension and comparable remuneration from a public service or official relationship or from an insurance-free employment relationship with the right to pension according to civil service regulations or principles as well as comparable payments from the pension of the MPs; if no additional accident compensation is paid, number 4, last clause applies accordingly,
  • Pensions of the public insurance or pension institutions of certain occupational groups due to reduced earning capacity or age,
  • the occupational injury compensation in accordance with § 30 para. to 11 of the Federal Pension Act and other laws that provide for the appropriate application of the performance requirements of Federal Supply Act 3,
  • Old age or reduced earning capacity pensions that have been promised due to an employment relationship (company pensions),
  • Pensions due to old age or reduced earning capacity from private life and pension insurance, general accident insurance and other private pension pensions.
