European Jurisdiction and Enforcement Convention

The European Jurisdiction and Enforcement Agreement (Brussels Convention) , full text of the Convention on jurisdiction and the enforcement of judgments in civil and commercial matters , shortly Brussels Convention is an international agreement of 27 September 1968 on the judicial jurisdiction and fashion the enforcement of decisions in matters of civil and commercial law .

The convention is often seen as the beginning of a unified “judicial area” in Europe. The convention was adopted by the first six EU member states ( EEC-6 ), but did not become law until 1973. For the EFTA states (i.e. Iceland, Norway, Switzerland, but not Liechtenstein), the Lugano Convention on Jurisdiction and the Enforcement of Judgments in Civil and Commercial Matters ( LGVÜ ) , which is almost literally the same as the Brussels Convention, applies . The European Jurisdiction and Enforcement Convention, concluded as an international agreement, was replaced with effect from March 1, 2002 for all states of the European Union , with the exception of Denmark , by the Brussels I Regulation (EC) No. 44/2001 (EuGVVO) .

With regard to Denmark, a separate international law agreement was reached on October 19, 2005, according to which the Brussels Convention is to be replaced by the current provisions of the EU regulation for Denmark as well . This international law regulation came into force on July 1, 2007.

In accordance with Art. 66 EuGVVO, the EuGVÜ continues to apply to actions brought before March 1, 2002 and enforcement titles obtained.
