European Economic Area Family Permit

from Wikipedia, the free encyclopedia

The European Economic Area Family Permit abbreviation EEA Family Permit (German: Entry permit for family members of nationals of the states of the European Economic Area) is the entry permit issued by the United Kingdom for citizens of citizens of the European Economic Area and Switzerland who, as third-country nationals, are not citizens of States of the EEC are. It is the national implementation of the European Union's directive on freedom of movement .

Legal basis

The legal basis is the Immigration (European Economic Area) Regulations 2006 , the national implementation of Directive 2004/38 / EC .

Procedure

The EEA Family Permit is applied for by citizens of the EEC who are third-country nationals and who travel with their EEC nationals to the United Kingdom for short stays and require a visa there. If you are traveling without your loved one, a UK national visa is required. As with a visa, the application must be submitted to the responsible diplomatic mission abroad. If a long stay is planned, citizens of visa-free states as third-country nationals of an EEC citizen must also apply for an EEA Family Permit before entering the country. The EEA Family Permit is valid for six months.

Residence Card and Permanent Residence

Nationals of EEC or EU citizens do not need to apply for a residence permit or residency permit in the UK . A residency card can be applied for. This is valid for five years but is purely declaratory since the residence status results from the status as a member of an EEC citizen itself. If no residency card is available, a valid EEA Family Permit must be available upon entry and exit in order to be able to prove the status of a third-country national. EEC citizens themselves can receive a Registration Certificate that proves their residence status. After five years of legal residence in the UK, permanent residence can be applied for, which is indefinite and allows independent residence status for EEC nationals.

criticism

There were several complaints about the use of the EEA Family Permit . First, the non-validity of residence cards from other EU countries as entry documents into the United Kingdom and the 15-page application form. Here questions are asked about private life, which go beyond the simple and quick issuing of visas, as required by the EC directive. In the opinion of the European Commission , the application of the EEA Family Permit violates the underlying EC directive on these points.
