Exceptio doli praesentis

The exceptio doli praesentis ( exceptio generalis ) was a special case in Roman law of the exceptio doli (deceit).

With the objection, the defendant asserted that the action brought constituted an abuse of law. The defendant did not object to the underlying obligation, for which the exceptio doli praeteritis was to be used, but the unfaithful motivation for bringing the lawsuit itself.
