General staff council

The General Staff Council ( GPR ) is a special lobby group within the public service . He is elected in addition to the local staff councils in the departments that are spatially or organizationally separated from each other. He is politically neutral.

Formation of general staff councils

The detailed requirements for the formation of a general staff council are regulated differently in the Federal Staff Representation Act and the staff representation laws of the federal states.

In the area of ​​application of the Federal Personnel Representation Act (i.e. in federal authorities), a majority resolution of the employees entitled to vote is required according to Section 6 (3) BPersVG. The same applies in accordance with Section 6 (3) of the Bavarian Personnel Representation Act .

According to Section 1 (3) LPVG NRW , parts of the agency are made independent in North Rhine-Westphalia by resolution of the respective highest service authority (with the consent of the previously responsible staff council in accordance with Section 72 (4) No. 12 LPVG NRW).

Election and administration

The same applies to the term of office and administration of the general staff council as to the respective individual staff councils. The number of mandates of the full staff council is limited in the state laws, z. B. in Baden-Württemberg to a maximum of 11, in NRW to a maximum of 15 people. The regulations for exemption from general staff council members also differ in detail from the exemption regulations in the individual staff councils.

Employees have the right to vote for both the individual staff council and the general staff council. As a rule (as a rule ) the election boards for the election of the individual staff councils are responsible for carrying out the voting process for the election to the full staff council ; the election committee for the entire staff council summarizes the individual election results.

Responsibilities

The General Staff Council i. d. Usually for matters that affect several departments within an organization. Examples are general service instructions, working time regulations, regulations on occupational safety and performance pay . If the general staff council concludes a service agreement with the agency management, such an agreement takes precedence over agreements made by the individual staff councils ( Section 73 (2) BPersVG, Section 70 (2) LPVG NRW, Section 73 (3) Bayer. PersVG).

Although sometimes individual personnel matters also have to be dealt with by the general staff council (in certain case constellations), the general staff council is not to be understood as a superior position vis-à-vis the individual staff councils. H. the GPR cannot repeal any other resolutions of the individual staff council as a kind of "appeal body".
