Law on Fugitive Offenders and Mutual Legal Assistance in Criminal Matters

The draft law on fugitive offenders and mutual legal assistance in criminal matters (Chinese: 2019 年 逃犯 及 刑事 事宜 相互 法律 協助 法例 (修訂) 條例 草案; English : Fugitive Offenders and Mutual Legal Assistance in Criminal Matters Legislation (Amendment) Bill 2019 ) ( Chapter 503) with regard to special surrender regulations and the Ordinance on Mutual Legal Assistance in Criminal Matters (Chapter 525), provides that agreements on mutual legal assistance can be made between the Chinese Hong Kong Special Administrative Region and any place outside Hong Kong. The law was proposed by the Hong Kong government in February 2019 and withdrawn in September of that year. It foresees the introduction of a mechanism for the movement of refugees not only for Taiwan but also for mainland China and Macau , which are not covered by the applicable laws.

The introduction of the law attracted widespread criticism from lawyers, journalists' organizations, business groups and foreign governments at home and abroad, fearing further erosion of the Hong Kong legal system and its built-in guarantees, and undermining Hong Kong's business climate. They were concerned about the increased risk that Hong Kong citizens and foreigners traveling through the city could be sent to mainland China for trial, where the courts are under Chinese political control. The Taipei authorities said Taiwan would not agree to extradite Hong Kong suspects on the grounds that Hong Kong Taiwanese citizens were at greater risk of extradition to mainland China under the proposed law and suggested that the legislation is politically motivated. The Hong Kong government's rush to implement extradition legislation also set a precedent for procedural guarantees in the Legislative Council.

The bill was officially withdrawn on October 23, 2019.
