Commercial law (Austria)

Commercial law is part of the special administrative law , which primarily serves to avert danger . Commercial law is part of business administration law .

In Austria, the norms of trade law are laid down in the trade regulations 1994 (amendment 2002). It is valid for all commercial activities. Members of the “liberal professions” such as doctors, lawyers, civil engineers and artists do not fall under the regulations of the trade regulations . The following regulations are contained in the trade regulations:

  • general access regulations
  • personal requirements (ability, reliability)
  • factual requirements (facilities, requirements - only for the chimney sweep trade)
  • Organization of a commercial enterprise (sponsoring person or company, managing director, naming)
  • Approval of operating facilities

There are also numerous other laws and regulations in the areas of labor law , corporate law and environmental law .

Membership in the Austrian Chamber of Commerce is compulsory for businesses.
