A penalty release (in the German penal code: penalty release ) is the release of the remainder of a custodial sentence on probation determined by a court order . After the probation period has expired without any complaints, it extends to the remainder of the imposed custodial sentence that has not been served.

A repayment of the penalty in the Federal Central Register differs from this penalty exemption, as it depends on the amount of the penalty and the number of convictions after certain deadlines have expired.

According to the penal code, custodial sentences can be suspended after two thirds of the prison term. Under certain conditions, a suspension on probation after half of the imprisonment is possible (one then speaks of 'half imprisonment ' , § 57 StGB). One of the prerequisites is that the convicted person is serving a prison sentence for the first time.
