Federal deposit regulations

The procedure to be observed when making a deposit was regulated in Germany by the deposit regulations (HinterlO) .

The substantive legal effect and reasons for the deposit, however, can be found in the provisions of §§ 372 ff. BGB .

Depositary transactions are carried out by depository offices and depository funds. The duties of the depository are assigned to the local courts . Depository coffers are the coffers of the administration of justice .

In the opinion of the Commission of the Federal States, the deposit regulations have for the most part not become federal law and therefore continue to apply as state law. A genuine separation of state and federal law is not possible. Therefore, the regulations in the individual federal states may differ from one another. Individual federal states have issued implementing ordinances on the deposit regime.

With Article 17 of the Second Act on the Adjustment of Federal Law in the area of ​​responsibility of the Federal Ministry of Justice , the deposit regime was repealed as federal law with effect from December 1, 2010.
