The Hypothekenbankgesetz (HBG) regulates the rights and obligations of the mortgage banks in Germany .
Main purposes of the HBG were:
- Definition of the term mortgage bank
- Definition of the term Pfandbrief
- Cover for Pfandbriefe
- Trustee Regulations
The HBG regulations related primarily to mortgage banks; however, many provisions apply analogously to all banks , such as B. the regulations on the mortgage lending value in § 12 HBG.
The HBG was repealed on July 19, 2005. Its regulations were replaced by those of the Pfandbrief Act (PfandBG), but remained in effect in certain cases within the framework of transitional provisions pursuant to Section 43 , Section 50 (2) of the PfandBG.
