The Valuation Ordinance ( WertV ) governed in Germany general principles for the determination of fair values for real estate . The WertV thus regulated the interpretation of the market value definition in § 194 BauGB . The expert committees must apply the WertV bindingly.
The last version of the WertV was issued on December 6, 1988 and was last amended on August 18, 1997. To distinguish it from earlier versions of the WertV, one speaks of the WertV 98 .
The valuation procedures regulated in the WertV are also called standardized procedures:
- Comparative value method according to § 13 to 14 WertV
- Capitalized earnings method according to § 15 to 20 WertV
- Material value procedure according to § 21 to 25 WertV.
Valuation guidelines have been issued in addition to the Valuation Ordinance .
Real estate valuation ordinance
On April 1, 2009, the Federal Cabinet introduced the draft of the "Ordinance on the principles for determining the market values of properties (Real Estate Valuation Ordinance - ImmoWertV)", which the Federal Council initially only approved subject to some changes, in particular the derivation of the standard land values. The Federal Council then approved a new draft on May 7, 2010; on May 19, 2010 the ImmoWertV was enacted by the federal government. The announcement was made on May 27, 2010 ( Federal Law Gazette I p. 639 ). The ImmoWertV thus replaced the WertV on July 1, 2010 ( § 24 ImmoWertV).
In the ImmoWertV, additional aspects are taken into account when determining the value, such as the energetic quality of the building or the value relevance of urban planning circumstances (§ § 4 ff. ImmoWertV).
