The Regulation (EC) no. 1049/2001 is a European Union regulation that the EU Commission regulates access to European Parliament, Council and. After that, all EU citizens have the right to receive documents from the institutions on request.

The regulation is intended to guarantee the transparency of the EU institutions and thus ensure better participation of citizens in the decision-making process. In particular, documents relating to the legislative process of the European Union should be made directly accessible to the greatest possible extent.

Structure of the regulation

The regulation consists of 19 articles:

  • Articles 1 to 3: General provisions (purpose, authorized access and scope, definitions)

Following a lawsuit by former civil servant Emilio de Capitani against the European Parliament, the Court of the European Union ruled on March 22, 2018 that the EU institutions must also issue documents from informal trialogues based on Regulation 1049/2001 .
