The integration law in Austria was passed on June 8, 2017. The aim of the law is to enable certain foreign groups of people to integrate into Austrian society.
Come into effect
In accordance with Section 27 (1) of the Integration Act, Sections 1 to 6 and 17 to 28 came into force on the day it was announced (June 8, 2017). Sections 7 to 16, with the exception of Section 13 (2), come into force on October 1, 2017. Section 13 (2) comes into force on January 1, 2018.
history
On August 18, 2016, the Federal Minister for Integration, Sebastian Kurz, announced an integration law that should come into force in the course of next year. More rights, such as a legal right to a German course, but also more obligations such as the obligation to participate in German and values courses for refugees should be anchored. The joint SPÖ / ÖVP government negotiated the individual points of the law and agreed on a joint government proposal on May 28, 2017.
Content and regulations
Part 1 of the Integration Act regulates its general provisions. According to § 1 IntG, the aim of the law is to enable persons legally resident in Austria to integrate into Austrian society by offering integration measures (integration promotion) and by obliging them to participate (integration obligation). According to § 3, the law is aimed at persons entitled to asylum, persons entitled to subsidiary protection and third-country nationals who do not have Austrian citizenship.
The second part regulates integration measures. According to § 4 the federal government must allow German courses up to A2 level , according to § 5 also orientation and values courses. Section 6 regulates obligations to cooperate and possible sanctions. The second main part of the 2nd part regulates from §§ 7 to 16 a uniform integration test for modules 1 and 2 of the integration agreement .
The third part consists of institutional measures such as the establishment of an expert council for integration and integration monitoring.
The 4th part regulates the penal and final conditions of the law.
