Judicial Council in Azerbaijan

The Judicial Council of the Republic of Azerbaijan was established in February 2005. He oversees the judiciary in the Republic of Azerbaijan .

Foundation and history

The Judicial-Legal Council of the Republic of Azerbaijan (English: Judicial-Legal Council , az : Məhkəm Hü-Hüquq Şurası ) was founded in February 2005, based on a law of December 28, 2004.

On June 22, 2007, the Judicial Council, the judicial body in Azerbaijan, presented a new code of conduct “On the ethical conduct of judges”, which sets out the guidelines for conduct as well as standards and specific requirements for judicial activity, the attitude to professional activity, good behavior and extrajudicial activity the judge regulates.

Rights and obligations

The main task of the Justice Council is to organize the functioning of the judiciary in the Republic of Azerbaijan . The Judicial Council's powers include assessing the performance of judges.

The Council of Justice undertakes to improve the quality of the training of judges. For this purpose, a Judicial Academy of the Republic of Azerbaijan was established in 2006 .

The Judicial Council is responsible for ensuring the personal independence of judges. He must prevent possible adverse effects on the judiciary .

Judges are subject to official supervision incumbent on the Judicial Council , although official supervision is limited by the judicial independence.

Disciplinary proceedings against judges

The Judicial Council is authorized to initiate disciplinary proceedings against judges . The judge must be informed of the initiation of disciplinary proceedings. He must be informed about the wrongdoing that he is charged with. Possible actions include reprimand, demotion, and removal from service.

It is possible to file a complaint against the decision of the Judicial Council within 20 days. The complaint goes to the plenary session of the Supreme Court of the Republic of Azerbaijan . In the plenary session of the Supreme Court, the decision of the Judicial Council can either be changed, not changed or deleted in three months.

Judges selection committee

The Judicial Council organizes a judges' election committee consisting of eleven members from the judiciary administration, the public prosecutor's office , the courts, as well as lawyers and legal scholars . The members of the judges' election committee are elected for five years.

For appointment as judges, the Judicial Council proposes candidates who have successfully completed all electoral procedures to the executive body.

Organization and legal basis

The Judicial Council consists of 15 elected members from the public prosecutor, legislature, executive and judiciary (nine judges). The Minister of Justice is the chairman of the Justice Council.

The seat of the Judicial Council is in Baku. Fikrat Mammadov is currently the head of the Justice Council.

The legal bases for the work of the Judicial Council are primarily the Constitution , the Law on the Judicial Council and the Law on Courts and Judges of the Republic of Azerbaijan.

After the adoption of the Law on the Judicial Council, the courts and the Judicial Council will be financed from the state budget of the Republic of Azerbaijan. This reduced the financial dependence on the executive branch.
