The barracks order is a collection of official orders , the purpose of which is to ensure that work and service operations in military properties of the Bundeswehr are as smooth and safe as possible.

The barracks regulations apply in the area of ​​responsibility of a barracks commander and are issued by him. It is not only valid inside a barracks, but also in its outside areas, if these belong to the corresponding property. In this respect, there would be an inadmissibly shortened interpretation of the term if one were to speculate that the scope of a barracks order would end immediately after leaving the barracks. The area of ​​application of the barracks regulation is therefore not congruent with the visible outer border of a barracks , but always congruent with the area of ​​responsibility of the barracks commander who issued the barracks.

Legal bases

The legal basis of the barracks regulations are the applicable laws and ordinances. In most cases, it also contains decisions from various departments that are within the scope of the barracks regulations. Example: The barracks regulations can also regulate the canteen times of the individual departments in order to prevent a "crowd" on the troop kitchen. Of course, this requires agreements between the departments concerned, which become part of the barracks regulations. Furthermore, by law, participation rights must be upheld before a barracks order can come into force.

Since the barracks commander is in the special area of ​​responsibility according to his superior position (see § 3 Superiors Ordinance ), the barracks regulations have the character of a command for soldiers of the Bundeswehr staying in their area of ​​application . However, it is not possible to formulate the barracks order as a mere order, since it is also aimed at people who do not receive orders from a military superior, e.g. B. civil members of the armed forces or visitors not belonging to the armed forces, although they must also follow the barracks regulations.

Violations

A violation of the barracks regulations is usually punished in lighter cases by a warning, in serious or repeated cases often by a ban on entering the property (for people who are not members of the Bundeswehr) or a disciplinary measure (for civil or military members of the Bundeswehr). In particularly serious cases, the provisions of the Military Penal Act (e.g. if a soldier persistently opposes the barracks regulations) or the Criminal Code are checked for applicability.
