Consultative vote

The advisory vote is a form of voting, which has not legally binding.

Switzerland

In Switzerland , such a vote can take place in a commercial enterprise on the occasion of the general assembly , but is mainly held at the community level in order to prepare political business.

The Federal Supreme Court has declared a consultative vote at the municipality level regarding a municipality merger as binding for the canton. On the other hand, the canton of Schaffhausen was refused a consultative vote on a similar issue due to a lack of a legal basis.

Since 1987, the Swiss Constitution has given the voters of Switzerland and its cantons a direct counter-proposal with a double yes with a ballot question. This represented a consistent further development of a consultative vote in a legally binding form.

Liechtenstein

In Liechtenstein , the consultative vote is one of the three forms of referendum; the other are the authority referendum based on a state parliament decision and the optional referendum . Between 1921 and 2009 there were 59 referendums, including only one consultative vote, on the introduction of women's suffrage on July 4, 1968. Although women formed a slightly larger number of voters, the opinion poll was negative with 54.5% of the votes.
