Civil partnership certificate

In Germany, a civil partnership certificate is proof of the establishment of a civil partnership ( Section 54 Paragraph 2, Section 55 Paragraph 1 No. 3 PStG ). The civil partnership certificate is one of the civil status documents .

The civil partnership documents are created and notarized by the registrar from the entries in the civil partnership register.

Content of the civil partnership certificate

In the civil partnership document are gem. 58 PStG added:

  1. The first names and surnames of the life partners, place and date of their birth as well as the legal affiliation of a life partner to a religious community , provided that the affiliation results from the register entry.
  2. Place and date of the establishment of the civil partnership

If the civil partnership is dissolved or if the non-existence of the civil partnership is established, this will be indicated at the end of the civil partnership certificate, stating the reason and time.

Significance since marriage was opened for same-sex couples

Since the law introducing the right to marry for persons of the same sex ( marriage for all ) came into force on October 1, 2017, civil partnerships can no longer be established, but according to § 20a LPartG can be converted into a marriage . Section 17a (1) of the PStG stipulates that the life partners must prove the existence of their civil partnership by means of public documents in order to register the conversion of their civil partnership into a marriage (see Section 30 of the PStV ).

The conversion of the civil partnership into a marriage corresponds legally to a marriage within the meaning of § 14 PStG. The date of the conversion is recorded in the marriage register. When registering the marriage, the life partners must present the documents in accordance with Section 12 (2) No. 1 to 3 PStG, which also include the civil partnership certificate. In the case of the conversion of a civil partnership into a marriage, the leading texts in the marriage certificate for the same-sex spouses must be neutralized (instead of "husband" and "wife", the leading text "spouses"). Following the first notarization, there is a subsequent notarization, in which "marriage according to § 17a PStG in the case of an existing civil partnership" is to be given as the occasion for the notarization. The conversion of the civil partnership into a marriage is also entered as a subsequent document in the civil partnership register.
