A civil status certificate as proof of civil status is either a certified extract or a certified original copy from a civil registry at the registry office .

Types of documents

The registry office issues the following civil status documents in accordance with Section 55 of the Personal Status Act (PStG):

  1. certified printouts from all civil status registers,
  2. from the marriage register marriage certificates ; Until the marriage has been certified in the marriage register, marriage certificates can also be issued from the record of the marriage,
  3. from the civil partnership register civil partnership documents ; Until the civil partnership is notarized in the register, civil partnership documents can also be issued from the record of the conclusion of the civil partnership,
  4. birth certificates from the birth register ,
  5. death certificates from the death register ,
  6. certified copies of the collection of death declarations .

The registry office has to be issued in accordance with § 55 para. 1 PStG civil status records in accordance with § 48 PStV to use the forms to the specimens of plants for PStV.

Not to the civil status records include the certificate of citizenship , the possession of German nationality with documentary documented evidence.

The descent of a person is proven by a birth certificate (stating only the legal parenthood, i.e. if the adoption has taken place without stating the natural parents) or by a certified birth register printout (stating the natural parents , but possibly also the adoptive parents). Upon request, no information about the parents, the gender of the child and possibly the religious affiliation of the parents or the child will be included in a "small" birth certificate. Pedigree certificates have not been issued since January 1, 2009.

In the marriage certificate , the first names and surnames of the spouses, the place and date of their birth, if applicable the legal affiliation of the spouses to a religious community as well as the place and date of marriage are recorded. If the marriage is dissolved, the reason and time of the dissolution are given at the end of the marriage certificate.

The previous marriage book (predecessor of the current marriage register until the end of 2008), from which the marriage certificates were issued, was supplemented by so-called family books between 1958 and 2008 . The marriage entries in the marriage book were no longer updated (for example with regard to the dissolution of the marriage) if a family book existed. The family book was updated. Unlike a marriage certificate, an extract from the family book therefore contained updated information with the marital status of the spouses, the date and place of their marriage, the names of the parents of the spouses, as well as the dates of birth of the children resulting from this marriage, but also information about a possible divorce or the Death of the spouses.

The death certificate includes the first name and surname of the deceased, place and date of his birth, if applicable his legal affiliation to a religious community, the last place of residence and marital status of the deceased as well as place and time of death.

The registry offices in Berlin , Hamburg , Mecklenburg-Western Pomerania , Lower Saxony , North Rhine-Westphalia , Bremen , Saxony-Anhalt and Schleswig-Holstein also issue civil partnership documents based on state law provisions . In Bavaria , the State Chamber of Notaries issues civil partnership documents; In the other federal states, the authorities before which a civil partnership was established issue official certificates, some of which are also referred to as civil partnership documents.

Prerequisite for the grant

Civil status certificates are to be issued on request to the persons to whom the entry in the register relates, as well as their spouses, civil partners, ancestors and descendants. Other persons have the right to have civil status certificates issued if they can prove a legal interest; in the case of the birth register or death register, it is sufficient to substantiate a legitimate interest if the application is made by a sibling of the child or the deceased. Persons over 16 years of age are entitled to apply.

In special cases ( adoption , change of first name according to the Transsexual Act ) as well as any blocking notices , the group of people who can request the issuance of civil status certificates is restricted.

A legal interest, which must be made credible to the registrar , exists if the document is used to pursue one's own legal interests , e.g. B. for the documentation of a certificate of inheritance application is required.

Before the update period expires (110 years for births and 80 years for weddings), use is possible even if a legitimate interest (e.g. family research) can be substantiated if 30 years have passed since the death of the last person involved.

Since January 1, 2009, the fees for civil services have been regulated by state law in compliance with the cost recovery principle .

According to Section 53 of the Civil Status Act, civil status documents are certain extracts from the central civil status register . The civil status authorities issue birth, marriage and partnership certificates as well as death certificates, which are to be certified by the district administrative authority and the governor on request. Abroad, civil status documents, extracts from the register, certificates of marital status and confirmations of the ability to establish a registered partnership can also be issued by the Austrian representative authorities.
