Civil status register

The electronic civil status register (§ 3 PStG new) is an electronic register introduced in Germany on January 1, 2009, which replaced the previous civil status registers. The legal basis for the conversion to electronic registers was created in 2006 by the Civil Status Reform Act. Until December 31, 2013, the civil status registers could still be kept on paper for a transitional period, albeit with the content according to the new law.

The register entries consist of a documentary part (main entry and subsequent notifications) with evidential value and a reference part without evidential value.

The civil status registers are kept electronically. The first notifications in the civil status registers are numbered consecutively every year. The basic entry has the ordinal number 0, the first subsequent authentication 1, etc.

Notarizations are concluded with the indication of the registrar's family name . Each certification must be provided with the permanently verifiable qualified electronic signature of the registrar.

The federal states can set up central registers to which all affiliated registry offices have access (§ 67 PStG new).

Marriage register

In the marriage register (§ 15 PStG new) are notarized after the marriage

  1. Day and location of marriage
  2. the name and the family name of the spouses, place and date of birth as well as at the request of a spouse's legal affiliation to a religious community , the public body is
  3. the surnames of the spouses after the marriage.

  1. on the notarization of the birth of the spouses
  2. the citizenship of the spouses if they are not German and their foreign citizenship has been proven
  3. on the determination of a married name .

Civil partnership register

Since October 1, 2017, no new civil partnerships can be concluded, as same-sex marriages have also been possible since then.

In the civil partnership register (§ 17 PStG new) are notarized following the conclusion of the civil partnership

  1. Date and place of the formation of the civil partnership
  2. the first name and the last name of spouse, place and date of birth and wish a life partner its legal membership of a religious community , the public body is
  3. the surnames of the civil partners after entering into a civil partnership.

However, Section 23 LPartG in the version of the Civil Status Reform Act still allows the Länder to provide for different jurisdiction for establishing civil partnerships and for keeping the relevant register (e.g. for notaries ).

Birth register

The following four items of information are recorded in the birth register (§ 21 PStG new):

  1. the child's first name and surname
  2. Place and day, hour and minute of the birth
  3. the gender of the child ( male , female , diverse or left open, see Civil Status Act from 2013 )
  4. given names and surnames of parents, and at the request of a parent's legal affiliation to a religious community , the public body is

If a child is stillborn , only the information prescribed in Nos. 2 to 4 will be included with the addition that the child is stillborn. At the request of a person, the live birth in the child custody would have been entitled, including information pursuant to no. 1 shall be entered. If personal care had been granted to both parents in the case of a live birth of the child and if they did not have a common family name, a family name for the child can only be entered if the parents agree on the name of one parent.

Please note the following regarding the birth entry:

  1. on the nationality of the parents if they are not German and their foreign nationality has been proven
  2. in the case of a child whose parents are married to each other , to their marriage
  3. on the notarization of the birth of the mother and the father
  4. on the acquisition of the German citizenship of the child according to § 4 Paragraph 3 of the Citizenship Act

Death register

In the death register (§ 31 PStG new) are notarized

  1. the first name and the last name of the deceased, place and date of his birth and at the request of persons reporting the legal affiliation of the deceased to a religious community , the public body is
  2. the last place of residence and the marital status of the deceased
  3. Place and day, hour and minute of death
