Activation and professional integration measures

Activation and professional integration measures in accordance with Section 45 of the Third Book of the Social Code (SGB III) are a term used in German employment promotion law. They belong to the services of active employment promotion within the framework of labor market policy . They are intended to improve the chances of integration into the labor market for people who are unemployed, at risk of unemployment or who are looking for a training position.

The measures available were reformulated by the law on the realignment of labor market policy instruments of December 21, 2008. As a result of the new numbering of the paragraphs of SGB III, which has been in effect since April 1, 2012, the measures are no longer regulated in Section 46 SGB III, but in Section 45 SGB III.

The term measures for activation and professional integration include the following measures, which were previously individually regulated by law:

  1. Measures to determine suitability (formerly Section 49 (1) SGB III), also in accordance with Section 37 SGB ​​III
  2. Support of the unemployed person's search for a new job (formerly Section 49 (2) No. 1 SGB III)
  3. Providing necessary knowledge and skills to facilitate placement in work (formerly Section 49 (2) No. 2 SGB III)
  4. Measures that lead to self-employment
  5. Measures the content of which is the identification, reduction or elimination of obstacles to placement and the aim of which is the placement of a job or training position (formerly Section 421i SGB III)
  6. Measures in which the Federal Employment Agency commissions a third party ( training provider , private employment agency , etc.) to place the unemployed person in employment subject to social security contributions (formerly Section 37 of Book III of the Social Code)

Individual measures can also pursue several objectives, such as the following measures:

  • Holistic integration service (GanzIL)
  • New customer activation (NKA)
  • Support of mediation with a holistic approach (UVgA)

Measure carrier

Measures can be carried out by state or private educational institutions , private employment agencies or by employers who want to determine the suitability of an unemployed person for a particular job before hiring him. An employment relationship does not result from an operational measure. The employer only incurs costs for statutory accident insurance . The otherwise widespread (illegal) unpaid "trial work" does not offer this important insurance protection. The participant in integration measures is still entitled to unemployment benefit or unemployment benefit II , but is statistically not considered unemployed for this period because he is not available for the labor market.

Duration of the measures

The maximum duration of the measures is specified in Section 45 (2) SGB III and Section 16g (2) SGB II. There are three restrictions:

  • A measure to impart professional knowledge (e.g. training with educational institutions) must not exceed eight weeks.
  • Measures at an employer (e.g. internships or company training measures) are limited to a maximum of six weeks.
  • Measures to stabilize the taking up of employment are limited to a maximum of six months after taking up employment if the person is no longer in need of assistance due to the income to be taken into account.

Measures other than these three types are not subject to any statutory maximum duration.

Scope of services

The services of the Federal Employment Agency include course costs and, if applicable, examination fees, necessary travel and accommodation costs, costs for necessary childcare, costs for work clothing and equipment and, if applicable, costs for placement fees. Particularly low-threshold measures include social work and the holistic promotion of everyday skills and personality development, for example for aggressive young people, homeless people, people with mental and physical illnesses.

Discretionary performance and legal entitlement

The approval of integration measures is at the discretion of the employment agency or the job center. However, the new version of Section 45 of Book III of the Social Code means that people who have been unemployed for six months or more can request the Federal Employment Agency to authorize them to participate in such a measure and to assume the costs.
