Rental car with driver (Germany)

A rental car with a driver (in Germany also personal rental cars according to the PBefG ) is a vehicle that is rented with a driver - in contrast to self- drive rental vehicles from car rental companies .

According to Section 49 (4) PBefG, rental car traffic is characterized by the fact that

  • a passenger transport is carried out with a passenger car,
  • the passenger car may only be rented "as a whole",
  • the associated transport order was received at the company's headquarters or at the company's home,
  • so that journeys are carried out, the purpose, destination and sequence of which the passenger determines and
  • which are not in taxi traffic .

In contrast to the taxi, the rental car is not a form of public transport . To distinguish it from this - and to protect the taxi trade - the legislature in 1983 imposed some special obligations on rental car traffic:

  • After execution of the transport order, which may only be accepted at the company's headquarters or home , the rental car must return to the company's headquarters immediately, unless it has to be transmitted by radio before leaving its headquarters or the company's home or during the journey received a new transport order. Here one speaks of the obligation to return the rental car. This means that the rental car is not allowed to wait for incoming radio orders away from the company headquarters. He is also not allowed to pick up passers-by when spoken to or waved.
  • The rental car company must record the receipt of the transport order at the company headquarters or in the apartment and keep the record for a year. Here one speaks of the obligation to record in rental car traffic.

In contrast to taxis, rental cars in Germany can only be rented “as a whole”, which means that you cannot rent a seat by seat.

Like taxi drivers, rental car drivers need a driver's license to transport passengers , which is usually issued by the regulatory authorities after a medical examination (for mental and physical aptitude and, in particular, good eyesight). Furthermore, the applicant for this special driver's license must have had the normal driving license ("Class B") required for driving the vehicle for at least two years, be at least 21 years of age and guarantee that he is responsible for the transport of Passengers . The driver's license to transport passengers by rental car is issued for a maximum of five years and can then be extended for up to five additional years if the requirements are still met.

A special motor vehicle liability insurance must be taken out for the operation of a passenger car , which complies with the provisions of the Passenger Transport Act and has sufficiently high coverage for liability damage. The motor vehicle liability insurance for car rentals assumes the personal liability of the company and also covers personal injury and property damage to passengers and their luggage. Pure financial losses are only included in the insurance under very specific circumstances. Details on this are regulated in the general motor vehicle conditions (AKB) on which the insurance is based.

Insurance confirmation (eVB)

In the insurance confirmation (eVB) issued by the insurance company, the rental car is classified with the letter "M". Such an insurance confirmation is required for the registration of a passenger car, as this is the only way to ensure that the future insurance company can also offer adequate insurance cover. In contrast to private car insurance, rental car insurance is only offered by a few insurance companies. The insurance premium depends on the type of vehicle and the region in which the car is registered.

No-claims bonus (SFR)

When it comes to car rental insurance, there are usually no claims discounts . The longer the vehicle is registered and used without damage, the cheaper the insurance premium becomes. Special SFR apply to passenger car rentals. The assumption of private SFR is not possible because the car is in a higher vehicle group with a significantly higher insurance risk.
