The Milcherzeugnisverordnung (MilchErzV) is a German legal regulation for the food milk .

Regulatory content

In Section 1 (1), milk products are initially defined insofar as they are intended for use as food. This is followed by the requirements for manufacture and packaging in Section 2 , as well as in Section 3 f. the general and special labeling requirements. Finally, additives, foreign products and penal regulations are being made.

Legal reference and authorization to issue ordinances

The MilchErzV was passed on July 15, 1970 with the consent of the Federal Council . The basis for this was then and, according to the text of the ordinance, is still today, the Milk Act of 1930 , which has long since been repealed, as well as Art. 129 (1) of the Basic Law and the Food and Feed Code (LFGB).

A legal adjustment of the regulation to the meanwhile updated and updated Milk and Fat Act has not yet taken place (status: October 2017), regulation and law exist side by side . There is no authorization to issue ordinances under the Milk and Fat Act .

With the MilchErzV, EC directives EGRL 114/2001 and EGRL 61/2007 are implemented; there is no authorization to issue statutory instruments for this either. The LFBG thus functions as a kind of collection law .
