Gabriel Fernandez ( February 20, 2005 - May 24, 2013 ) was an eight-year-old child from Palmdale , California who was murdered. Gabriel was tortured and ill-treated for several months. Responsible for these acts, which ultimately led to his death, were his mother, Pearl Fernandez, and her boyfriend, Isauro Aquirre.

Abuse and death

Gabriel Fernandez was tortured, beaten and humiliated by Pearl Fernandez and Isauro Aguirre for several months. The couple were arrested after Pearl Fernandez called 911 on May 22, 2013 after finding their child unconscious in the Palmdale apartment, northeast Los Angeles. The boy's body had numerous broken bones, which his mother said came from a fall. The paramedics found the boy with the most serious injuries, including a fractured skull, broken ribs, burns and knocked out teeth. Two days later, Gabriel died in hospital as a result of his injuries.

Legal proceedings

On May 23, 2013, Isauro Aguirre and Pearl Fernandez were arrested. Aguirre was accused of attempted murder and Fernandez of endangering the child's welfare and child abuse. Aguirre was sentenced to the death penalty.

His life partner, Gabriel's mother, was sentenced to life imprisonment with no possibility of early release. Her sentence was milder than Aguirres because she pleaded guilty. In addition, her current intellectual disability reduced the sentence. She apologized for what she did. She is currently in Chowchilla Women's Prison in California.

Aguirre is on death row at San Quentin State Prison, California, pending execution of his sentence.

Lawsuit against social workers

In addition to Aguirre and Fernandez, four social workers were also charged, who were indirectly involved in the case at the time. They have been accused of minimizing the importance of the physical, mental, and emotional injuries Gabriel suffered. They were also accused of enabling further abuse of Gabriel as he was not withdrawn from the family. Thus, they were charged with child abuse and falsification of public records. However, the charges were dropped again as the prosecutors could not prove that the social workers had a duty to control the perpetrators and to provide care or custody of Gabriel.
