Intelligence means
Intelligence service means ( nd-means ) are methods, objects and instruments for secretly gathering information that are used by intelligence services ( Section 8 (2 ) BVerfSchG ). They are either conclusively listed in a formal law or in a non-public service regulation ( Section 8 (2) sentence 4 BVerfSchG ). The principle of proportionality must be observed when applying them ( Section 8 (2) sentence 3 BVerfSchG ).
Examples
Intelligence means can be ( § 5 Abs. 2 VSG NRW ):
- Use of V-people , other secret informant for the purpose of counterintelligence over recruited agents , investors, and undercover agents ;
- Observation ,
- Image recordings (photographs, videographs and films);
- Covert investigations and interviews;
- Listening in without using technical means;
- Monitoring and recording of the non-publicly spoken word outside of apartments using technical means;
- Observation of radio traffic on channels not intended for general reception and the visualization, observation, recording and decryption of signals in communication systems;
- Use of bogus biographical, professional or commercial information ( legends );
- Procurement, creation and use of camouflage papers and camouflage signs ;
- Interception and recording of telecommunications and use of tele-media services as well as open and view the top of the letter or postal secrecy underlying shipments;
- Access to secure telecommunication content and other information and communication content on the Internet
- Use of technical means to determine the location of an actively switched mobile radio terminal
- Collection of information about those involved in payment transactions and about money movements and investments with payment service providers
- Collection of information on telecommunication traffic data and usage data of telemedia services from those who provide telecommunication services and telemedia services on a business basis or participate in them
- Collection of the data stored according to Sections 95 and 111 of the Telecommunications Act from those who provide telecommunications services on a business basis or participate in them, also using an Internet protocol address assigned at certain times, as well as obtaining information according to Section 14 paragraph 2 of the Telemedia Act
police
Methods, objects and instruments for secretly gathering information are also used by police authorities, but are not referred to as intelligence means. The authority to use these means is derived from the Code of Criminal Procedure ( StPO ) for purposes of criminal prosecution and from the respective police laws for the purpose of averting danger .

The Federal Customs Administration ( Customs Criminal Police Office , Customs Investigation Offices ) is authorized to use methods, objects and instruments for secretly gathering information in accordance with the Customs Investigation Service Act ( ZFdG ).
